GENERAL TERMS AND CONDITIONS OF SALE

ARTICLE 1 — GENERAL PROVISIONS
The General Terms and Conditions of Sale (hereinafter referred to as the "General Terms and Conditions of Sale" or "GTC") apply exclusively to the online sale of products offered by the Operator on the website (the "Website").
The GTC are made available to customers on the Website, where they can be directly consulted. They can also be provided upon request by any means.
The GTC are binding on the customer, who acknowledges, by checking a box or clicking a button provided for this purpose, that they have read and accepted them before placing an order. The validation of the order through its confirmation constitutes acceptance by the buyer of the GTC in effect on the order date. The Operator ensures their conservation and reproduction.
ARTICLE 2 — PRODUCT DESCRIPTION
The Website is an online platform offering clothing and accessories for sale (hereinafter referred to as the "Product(s)"). It is accessible to any individual or legal entity using the Website (the "Customer").
Each Product offered on the Website is accompanied by a description (provided by the supplier or available via a link to the manufacturer's website) detailing its essential characteristics. Any images of the Products are for illustration purposes only and are not legally binding. If a user manual is essential, it is available on the Website or provided at the time of delivery. The Products comply with applicable French laws.
The Customer is responsible for their access to the Website, particularly via the Internet. This access may involve costs charged by technical service providers such as internet access providers, which remain the Customer’s responsibility. Furthermore, the Customer must provide and ensure the proper functioning of the necessary equipment to access the Website.
The Customer acknowledges verifying that their IT setup is secure and operational.
ARTICLE 3 — CREATION OF A CUSTOMER ACCOUNT
To place an order on the Website, the Customer must first create a personal account. Once created, the Customer must log in using their confidential username and password. The Customer is responsible for maintaining the confidentiality of their login credentials, as specified in the "PERSONAL DATA" article of these GTC.
Each Customer agrees to:

Provide accurate, truthful, and up-to-date information during the registration process.

Regularly update their information to maintain its accuracy and relevance.
The Customer agrees not to share unlawful, harmful, or objectionable information (e.g., defamatory or fraudulent content). Should the Customer violate this agreement, the Operator reserves the right to suspend or terminate the Customer’s account at their sole discretion.
After account creation, the Customer will receive an email confirming the registration.
ARTICLE 4 — ORDERS
The Operator endeavors to ensure the availability of all Products. Product offers remain valid as long as stocks last.
If a Product becomes unavailable after the Customer places an order, the Operator will notify the Customer via email promptly. The Customer may then choose between:

Receiving a Product of equivalent quality and price to the originally ordered Product, or

Obtaining a refund for the unavailable Product within thirty (30) days of payment.
The Operator is not obligated to provide any compensation for cancellations, except in cases where the Operator is directly at fault.
To place an order, the Customer must select Products, add them to their cart, review the cart’s content (including quantities and total price), and validate the order.
The Customer must confirm their understanding and acceptance of the GTC, along with shipping fees, delivery terms, and the withdrawal policy, before proceeding with payment. Order confirmation constitutes acceptance of the GTC and finalizes the contract.
ARTICLE 5 — PAYMENT TERMS AND SECURITY
The Customer acknowledges that placing an order on the Website constitutes an obligation to pay.
Payments are processed through Shopify Payments. The following payment methods are accepted:

American Express, Apple Pay, Credit Cards, MasterCard, Shop Pay, Visa
Payment by Credit Card:
Payments are made on secure banking servers, ensuring that the Customer's financial details do not transit through the Website. Transactions are encrypted using SSL (Secure Socket Layer).
The Customer's account is debited only after the payment is verified and approved by the bank. If payment cannot be processed, the order is automatically canceled.
Payment by Bank Transfer:
The Customer can also pay by bank transfer. The necessary bank details and order reference will be provided during the checkout process. Orders are processed within 48 hours after receiving the transfer.
ARTICLE 6 — PRODUCT PRICES AND PAYMENT
Product prices are listed in euros (€) inclusive of taxes (TTC), excluding delivery fees.
Delivery fees are added to the Product price and clearly displayed before order confirmation. The total amount due, including a breakdown of costs, is presented during the checkout process.
Payment must be made in full upon order confirmation.
ARTICLE 7 — CONTRACT FORMATION
The contract is formed when the Customer confirms their order through the "double-click" process, consisting of:

Reviewing the cart (products, quantities, prices, delivery terms).

Accepting the GTC and validating the order.

Finalizing payment by clicking "I pay."
This "double-click" constitutes an electronic signature equivalent to a handwritten signature.
ARTICLE 8 — RETENTION OF OWNERSHIP
The Operator retains full ownership of the Products ordered until full payment, including any applicable shipping fees, is received.
ARTICLE 9 — SHIPPING AND DELIVERY
The Operator commits to delivering the Products within the time frame specified during the order process, and no later than thirty (30) days after order confirmation.
Delivery costs are detailed during the checkout process and must be approved by the Customer before confirming the order.
Products are delivered to the address provided by the Customer. The Customer is responsible for ensuring the accuracy of the provided address. The Operator cannot be held liable for delivery delays or failures due to incorrect address information.
Upon receipt, the Customer must verify the Products’ conformity with the order and ensure the package is sealed and undamaged. Any issues must be noted on the delivery slip.
ARTICLE 10 — RIGHT OF WITHDRAWAL
The Customer has fourteen (14) days from the delivery date to exercise their right of withdrawal.
To initiate the withdrawal process, the Customer must fill out the standard withdrawal form available at [link]. Alternatively, the Customer may notify the Operator of their decision to withdraw via email or mail, including the following information:

Full name and contact details.

Order number and date.

List of Products to be returned.
The Customer is responsible for return shipping costs, unless the Product is defective or does not match the order.
Products must be returned in their original packaging, unused, and with all accessories.
Refunds are processed within fourteen (14) days of receiving the returned Products.

ARTICLE 12 — INTELLECTUAL PROPERTY
All elements of the Website (texts, images, designs, logos, etc.) are the exclusive property of the Operator and are protected by French and international intellectual property laws.
The Customer agrees not to reproduce, distribute, or modify any part of the Website without the Operator's prior written consent.
ARTICLE 13 — LIABILITY AND WARRANTY
The Operator cannot be held liable for non-performance of the contract due to the Customer, a third party, or in cases of force majeure as recognized by French courts.
The Customer acknowledges that the characteristics and limitations of the Internet do not guarantee complete security, availability, or integrity of data transmissions. The Operator does not warrant that the Website and its services will function without interruption or error. Temporary outages may occur due to maintenance, updates, or improvements.
The Operator cannot be held liable for the use of the Website by the Customer in violation of these GTC or applicable laws. In particular, the Operator is not liable for false statements or inappropriate behavior by Customers toward third parties. If the Operator is held liable due to the actions of a Customer, the Customer agrees to indemnify the Operator for all damages and legal costs incurred.
Legal Warranty of Conformity and Hidden Defects:
Products are covered by the legal warranty of conformity under Articles L.217-4 et seq. of the French Consumer Code and the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code.
When acting under the legal warranty of conformity:

The Customer has two (2) years from the delivery date to act.

The Customer may choose between repairing or replacing the Product, subject to cost conditions specified in Article L.217-9 of the Consumer Code.

The Customer is not required to prove the defect existed at the time of delivery for 24 months (6 months for second-hand goods).
Under the warranty for hidden defects:

The Customer can choose between rescinding the sale or receiving a price reduction (Article 1644 of the Civil Code).
ARTICLE 14 — COMMERCIAL WARRANTY
In addition to legal warranties, certain Products may come with a commercial warranty. Details of such warranties are specified in a written contract provided to the Customer.

ARTICLE 19 — GENERAL TERMS
Entire Agreement:
These GTC constitute the entire agreement between the Customer and the Operator. If any provision is deemed invalid by a court, the remaining provisions remain in force.
Modifications:
The Operator reserves the right to modify the Website and these GTC at any time without notice. The applicable GTC are those in effect at the time of the Customer’s order.
ARTICLE 20 — APPLICABLE LAW AND DISPUTES
These GTC are governed by French law.
